Aviation safety whistleblower Charles Shi worked at Moog Aviation from 2006 to 2016 which manufactures parts for airliners as East Asia Supply Chain Manager when he alleges he discovered documents certifying parts as safe was being falsified. He says he approached two other Moog employees investigator Claire Starzek and manager Joe Zou for the sub-contractor New Honji (NHJ) where Joe Zou he had a good relationship with their boss Li Jian. The falsification of ‘material specification’ meant that some parts from NHJ and their uncertified sub-contractors used substitute materials, sub-standard Aluminium and Steel, for 20 or so ‘critical parts’ and one ‘single point of failure part’. NHJ also failed to use traceability as specified in international aviation agreements. These aircraft part safety failings affect up to 500 Boeing 737airliners which Charles Shi suggests people should not fly in.

I. Case History

1.My name is Charles (Chaosheng) Shi. a Chinese Notional, I was formerly employed by the Aircraft Group of Moog Inc. as East Asia Supply Chain Manager. I served in that position for 10 years between 2006/09-2016/01. Since January 13, 2016, I have acted as a whistle blower to the Federal Aviation Administration (“FAA”) on an extraordinarily significant aircraft safety matter.(See Exh. 73 my updated resume)
2.FAA acknowledged my whistleblwoing on March 10,2016,See Exh. H. FAA assigned an investigator to my case, Mr. Robert Fortune, whom I communicated with several times in April,2016. See. Exh. 42. I requested at least four times that Mr. Fortune verify material facts regarding faulty aircraft parts and informed him of the part numbers he should verify material facts. However, FAA ignored my requests, and on June 1st the FAA closed the case without substantiating any violations. See Exh. I and Exh.E
3.I then submitted new evidence on 12th July and requested through the FAA Safety Hotline that the case be re-opened and re-investigated. See. Exh.40. Unfortunately my then US lawyer emailed me 2016/08/12 that FAA declined my request. See Exh.41.
4.Disappointed but not discouraged, on August 17th I submitted via my lawyer to the FAA Safety Hotline compelling objective evidence obtained from my own investigative endeavor that the Chinese supplier Suzhou New Hongji (NHJ) substituted 3 lots of approved raw material with over 700 pieces for a production order of some 1000 pieces of Moog machined parts. See. Exh. 22. The part number P665A-0039-02 that got particularly close attention in my whole internal and external whistleblowing is a single point of failure(SPOF) part for B737 spoiler. A SPOF part is a part of a system that, if it fails, will stop the entire system from working. See Exhibit RF20, the Part Description is block trunnion(mounting lug),Spoiler actuators are used to lift the wing flaps when airplane take-off and land to reduce/adjust speed. Exh. Moog116 and 117, If P665A0039-02, the SPOF fractured during landing or taking off due to use of fake material, the whole spoilers just get ripped off from the wing, causing catastrophic accidents.
5.At that time FAA did re-open the case, again with Mr. Fortune as the investigator. See Exh. 52,53, as my own investigation effort had produced objective evidence indicating that criminality and fraud has occurred and is continuing to occur, I and my US lawyer communicated with Mr. Fortune in an effort to have him notify other law enforcement agencies and thoroughly investigate this matter per FAA Order 8120.16A, Suspected Unapproved Part Program and FAA Order 2150.3B. On 4-3 of FAA Order 8120.16A, Coordinating Criminal Investigation, it states “If parts have been intentionally misrepresented, criminal activity may be involved, inspectors should refer to FAA Order 2150.3 for additional guidance and information about criminal investigation.”
6.According to FAA Procedure, the safety matter should be uncovered swiftly. however, more than two months passed, and the investigation appeared to have made no progress. This is notwithstanding the grave safety threat posed by the faulty/counterfeit parts that I have repeatedly asked FAA to look into.
7.Feeling Mr. Fortune might have abused his authority conducting the investigation, also feeling FAA itself did not take the matter seriously, I filed via email 31/10/2016 a request to FAA Administrator Mr. Michael Huerta demanding escalated investigation by FAA with LEA to uncover the criminality See Exh. 56.
