新公务员工会声明:失去个人言论及示威自由 对香港法治人权及深感忧虑
11月4日的民间记者会上,发言代表之一的颜武周宣布“新公务员工会”已成立,目标是促進新制公务员权益,保护公务员自由表达意见的权利。他说,公务员也拥有集会、示威和言论自由等权利,不应因为公务员身份而遭剥夺人权。又说同意公务员履行职责时要保持政治中立,但质疑政府未有客观地彻查警队执法问题。

捍卫公仆尊严回应港人诉求
自六月以来,香港经历了前所未有的创伤,社会上不同的界别,包括公务员同事,都难以幸免地被卷入这埸风波。
在公务员界别中,贸易主任同事在回家途中,因背囊有头盔及眼罩而于巴士上被捕;消防员同事在履行其救急扶危的天职时被指责为阻碍警方执行职务;有建筑署同事在执行职务时更被警员恐吓及殴打;近日有文职同事被捕时,却只换来政府一句未审先判的“不容公务员违法”;更甚者是有同事被要求留意个人社交平台上的言论。当公务员履行职责会被警察欺侮、会失去个人言论及示威自由时,我们对香港的法治、人权及未来深感忧虑。
作为香港市民的公仆,我们同意公务员在执行职务时必须要恪守专业,保持政治中立,履行应有的职责,如此才不负香港市民的期望。当政府未审先判文职同事“违法”时,有否同时客观审视香港警察有否“违法、违纪、失德”?此等行为的片段及佐证举目皆是:一)无视警察通例,故意不展示编号、擅自修改及无视武力指引;
二)失职失责,如721元朗恐袭故意不作为、涉嫌性欺凌被捕人士;
三)煽动人道仇恨,指骂示威者作曱甴;
四)漠视私有产权,强闯私人地方;及
五)不尊重上级,公然反对政务司司长的言论等。
凡此种种,政府是否应一视同仁要求警队恪守其职责及纪律,约束并惩处有违规行为的警务人员?
此外,特首要求政府不同部门配合警方行动。我们在此亦希望反问一句,当社会矛盾如此激烈,不少同事都感到焦虑不安,而公众对政府的观感亦大受影响,令同事在执行职务时倍增压力,政府高层又有没有为同事提供相关的支援及谅解?
我们无意制造对立及分化,惟警察明显无力解决当前的政治问题。我们在此重新促请特首及其管治团队:一)认真聆听及面对香港广大市民的诉求,以正面的方法及态度化解当前的矛盾;
二)以一视同仁的态度,要求政府各部门,包括警队恪守其专业及职责;及
三)为受反修例事件影响的公务员同事提供适切的行政及情绪支援。

Respond to citizens’ demands
Hong Kong has been experiencing trauma on an unprecedented scale since June. People from different sectors of society, including our civil service colleagues, found themselves inextricably embroiled in this crisis.
A Trade Officer was arrested on the bus on his way home for having a helmet and eye protection in his bag. A fireman providing emergency relief was accused of impeding the Police in the discharge of their duties. A colleague from the Architectural Services Department was threatened and beaten by a police officer while on duty. Civilian staff, when arrested in recent days, were given the government’s remark“civil servants should not violate the law” even before being convicted. Some colleagues were also reminded to pay attention to the messages they posted on their own social media accounts. At times when civil servants are bullied and humiliated by police officers while performing duties and losing freedom of expression and protest, we are deeply worried about Hong Kong’s rule of law, human rights of the citizens and even the future of Hong Kong.
Being servants of the Hong Kong people, we agree and spare no effort in upholding our unwavering commitment to professionalism, political neutrality and accountability for decisions in executing public duties, so as to meet the expectations of the public. At times when the Government declares our civilian staff colleagues guilty before trial, has the Government applied objective judgment in assessing whether the Hong Kong Police have breached any laws, regulations and codes of conduct? Footages and proofs showing their behaviours are widely available. These behaviours include:1) disregarding Police General Orders by wilfully concealing their identification numbers, amending without permission and failing to abide by guidelines on the use of force;
2) being in dereliction of duty by deliberately remaining on the sidelines in the incident of indiscriminate attack on civilians in Yuen Long and taking part in alleged sexual abuses on the arrested persons;
3) inciting hatred by dehumanising protesters as cockroaches;
4) neglecting private property rights by forcing their way onto private premises;
5) disrespecting their superior by blatantly criticising remarks made by the Chief Secretary for Administration.
In view of these, should the Government uphold the same principles and require the Police to comply with regulations when performing duties? Should disciplinary actions be taken when the police officers are found to have violated any regulations?
Besides, the Chief Executive has asked different government departments to co-operate with the Police. As such, if we may raise a question: our colleagues are anxious and worried when Hong Kong is faced with mounting social conflicts, and performing their duties under huge pressure when the public perception of the Government has been greatly affected. Has the senior management of the Government ever provided corresponding support and showed understanding for our colleagues?
We have no intention to create social division and confrontation, yet the Hong Kong Police are evidently unable to resolve the political issues we are facing. We hereby urge the Chief Executive and her governing team to:1) heed and address the appeals of the general public; endeavour to resolve the current conflicts using positive means and in a positive manner;
2) adopt equal principles and require government departments, including the Police to adhere to professionalism in their discharge of duties; and
3) provide appropriate administrative and emotional support to civil servants affected by the Anti-Extradition Law Amendment Bill Movement.
